It should be clear that for an oath to be valid, the utterance of the words of the oath is a condition. An oath is not valid by merely holding the Quran in one's hand without uttering the words. Therefore, in the case of a responsible person, if the person in question has only held the Quran in one's hand and has not uttered the words of the oath with his tongue, then the oath is not valid by that and neither will expiation be required for going against it.
واضح رہے کہ قسم کے صحیح ہونے کے لیے قسم کے الفاظ کا بولنا شرط ہے۔ صرف قرآن کو ہاتھ میں پکڑے بغیر الفاظ ادا کرنے سے قسم درست نہیں ہوتی۔ لہٰذا ذمہ دار کے معاملے میں اگر سوال کرنے والے نے صرف ہاتھ میں قرآن پکڑا ہو اور زبان سے قسم کے الفاظ نہ کہے ہوں تو اس سے قسم صحیح نہیں ہے اور نہ اس کے خلاف جانے پر کفارہ لازم ہوگا۔
