The estate of the deceased parents of the petitioner shall be distributed among their mentioned heirs according to the principle of inheritance in such a way that out of all the movable and immovable property, gold, silver, jewelry, cash and all kinds of small and large household goods left in their possession at the time of death, the average expenses of the burial of the deceased should be paid first. After that, if there is any debt due to the deceased, then it should be paid. After that, if the deceased has made any valid will, then it should be carried out to the extent of one-third (3/1) of the remaining property. After that, whatever remains should be divided into a total of nine equal parts, out of which (2) parts should be given to each son of the deceased and (1) part to each daughter.
درخواست گزار کے متوفی والدین کی جائیداد ان کے متذکرہ ورثاء میں وراثت کے اصول کے مطابق اس طرح تقسیم کی جائے گی کہ موت کے وقت ان کے قبضے میں باقی تمام منقولہ اور غیر منقولہ جائیداد، سونا، چاندی، زیورات، نقدی اور ہر قسم کے چھوٹے بڑے گھریلو سامان میں سے، اوسط اخراجات کے طور پر پہلے ادا کیا جائے۔ اس کے بعد اگر میت کے ذمے کوئی قرض ہو تو اسے ادا کرنا چاہیے۔ اس کے بعد اگر میت نے کوئی صحیح وصیت کی ہو تو باقی جائیداد کے ایک تہائی (3/1) کی حد تک اس پر عمل کیا جائے۔ اس کے بعد جو کچھ بچ جائے اسے کل نو برابر حصوں میں تقسیم کیا جائے جس میں سے (2) حصہ میت کے ہر بیٹے کو اور (1) حصہ ہر بیٹی کو دیا جائے۔
