It should be clear that divorce is a contract like other financial contracts, for the validity of which the mutual consent of the parties and the regular offer and acceptance are a condition, whereas in general, in a unilateral judicial divorce, this condition is missing, so such a degree is not valid according to Shariah, but rather the marriage continues to exist despite the issuance of this degree, and it is not correct for a woman to marry another man based on such a degree. Therefore, if the petitioner or his lawyer has not actually signed it accepting the judicial divorce, even if the petitioner later said that "I accept the court's decision...", then even then the issuance of this unilateral divorce degree did not end the marriage between the petitioner and his wife according to Shariah, but their marriage continues to exist. Therefore, it is unlawful and forbidden for the petitioner's wife to marry somewhere else based on this unilateral divorce degree. They must immediately separate from each other. And sincerely repent and ask forgiveness for the sins you have committed so far.
واضح رہے کہ طلاق دیگر مالی معاہدوں کی طرح ایک معاہدہ ہے جس کے جائز ہونے کے لیے فریقین کی باہمی رضامندی اور باقاعدہ پیشکش اور قبولیت شرط ہے، جب کہ عام طور پر یکطرفہ عدالتی طلاق میں یہ شرط موجود نہیں ہوتی، اس لیے ایسی ڈگری شریعت کے مطابق درست نہیں، بلکہ نکاح جاری رہتا ہے، اس کے باوجود مرد کے لیے دوسری ڈگری جاری کرنے اور اس کی بنیاد پر نکاح کرنا درست نہیں۔ ایک ڈگری لہٰذا، اگر درخواست گزار یا اس کے وکیل نے عدالتی طلاق کو قبول کرتے ہوئے اس پر درحقیقت دستخط نہیں کیے ہیں، چاہے درخواست گزار نے بعد میں کہا کہ "میں عدالت کا فیصلہ قبول کرتا ہوں..."، تب بھی اس یکطرفہ طلاق کی ڈگری کے اجراء سے درخواست گزار اور اس کی بیوی کے درمیان شریعت کے مطابق نکاح ختم نہیں ہوا، بلکہ ان کا نکاح برقرار ہے۔ لہٰذا، درخواست گزار کی بیوی کے لیے اس یکطرفہ طلاق کی ڈگری کی بنیاد پر کہیں اور شادی کرنا ناجائز اور حرام ہے۔ انہیں فوری طور پر ایک دوسرے سے الگ ہونا چاہیے۔ اور اب تک جو گناہ سرزد ہوئے ہیں ان کی سچی توبہ اور استغفار کریں۔
